An Important Letter For Hunters Transiting New York

You have probably heard about the problems some sportsmen have encountered when transiting New York with hunting firearms on their way to another state or country for a hunting trip. On various occasions, New York police have threatened to arrest hunters at both JFK and Albany International airports for illegal firearms possession based on New York state laws, and in at least one case a hunter's firearms were confiscated.

Well, some help is now available for hunters transiting New York. Seems Congressman Don Young, a long-time champion of sportsman, got involved in this issue a while back as Chairman of the Transportation Committee. Specifically, he wrote a latter to the Transportation Security Administration (TSA) demanding an explanation. TSA turned to the US Department of Justice (DOJ) for guidance, and it was DOJ that ultimately got back to Congressman Young.

The DOJ letter, written by Assistant Attorney General William E. Moschella, confirms that provisions of the Gun Control Act enable travelers to possess firearms legally in New York airports under the following conditions: 1) the person is traveling from somewhere he lawfully may possess and carry a firearm; 2) en route to the airport the firearm is unloaded and not accessible from the passenger compartment of his car; 3) the person transports the firearm directly from his vehicle to the airline check-in desk without any interruption in transportation; and 4) while carrying the firearm to the check-in desk it is unloaded and in a locked container.

"This interpretation reflects the apparent congressional intent in enacting this provision...," the letter reads. The assistant attorney general goes on to say that his office would inform New York law enforcement authorities of the Justice Department's interpretation of the law.

The importance of this letter cannot be under-estimated. In our view, anyone transiting New York with a firearm should have a copy of it in his, or her, possession.
